Abstract

This chapter examines a number of legal and ethical issues that have been associated with HIV since the beginning of the epidemic related to testing protocols. Included are issues of informed consent, pre- and post-test counseling, opt-in vs opt-out testing, mandatory testing, and the reporting of test results. In addition to topics related to testing, there are the associated issues related to confidentiality reviewed in this chapter. Finally, the chapter covers laws related to the criminalization of HIV and the issue of blood donation as well as laws and policies which need to be reviewed and updated based on current scientific knowledge.
